[攝影]International Garden Photographer of the Year(97/10/31)

1. GENERAL INFORMATION

1.1 The Garden Photographer of the Year competition (‘the Competition’) is an annual competition open to everyone except those involved in its organisation. The organisers of the Competition are Garden Photographer of the Year Limited (‘we/us’), a company incorporated in England and Wales under company number 05979340, whose registered office is at c/o Churchill & Co, Wessex House, 66 High Street, Honiton, Devon EX14 1PD and whose VAT Registered No. is [907 1947 11].

1.2 By entering into the Competition you agree to abide by the following rules (‘Rules’).

1.3 Images that have won an award in another public photographic competition are not eligible.

1.4 All entries must be uploaded via www.igpoty.com (‘the Site’). Please see Enter online page on our website for more information about how to do this.

1.5 No uploaded images will be returned, but all images, apart from those short-listed for awards, will be deleted after the close of the Competition.

1.6 You can use any type of camera or mobile phone to create your images. It is recommended that you use the highest image quality setting your camera can achieve.

1.7 The closing date for entries to the Competition is 31st January 2009.

2. ENTRY FEES

2.1 Entry to the Competition is subject to payment of entry fees, depending on which section of the Competition, and in which category, you wish to enter.

2.2 The sections of the Competition and the entry fees are as follows:

2.2.1 Young Garden Photographer of the Year (under 16 only) - single image only:
(a) 1 image per category - seven in all: free.
(b) A further 4 images in any one category: £5 per category.

2.2.2 Garden Photographer of the Year- single image:
(a) Up to 4 images in any category: £10 per category.
(b) A further 4 images in any additional category: £10 per category.

You can enter as many images in as many categories as you like. For more information see Help

2.2.3 Garden Photographer of the Year - Portfolio: A set of 6 themed images.
(a) 1 portfolio in any category: £20 per category
(b) Over 1 portfolio: £20 per category.

2.3 The categories of the Competition are:
(a) Plant Portraits;
(b) Wildlife in the Garden;
(c) Garden Views;
(d) People in the Garden;
(e) Trees;
(f) World Botanic Gardens;
(g) The Edible Garden;

2.4 Payment of entry fees can be made by any means specified on the Site.

2.5 Payment made be made in British Pounds (GBP), Euros, or US Dollars (USD). The exchange rate applied between British Pounds and other currencies will be that defined by the banking system at the time of purchase. Galpa Ltd does not exercise any control over these rates.

2.6 You have the right to cancel your order within seven days, see '13. Refund Policy'.


3. WINNING ENTRIES

3.1 The entries to the Competition in each section mentioned above will be judged as follows:

3.1.1 the winner of the Young Garden Photographer of the Year Award 2009 will be the person under 16
whose image or images are judged as the best submitted by entrants under 16 across all the categories;

3.1.2 the winner of the Garden Photographer of the Year Award 2009 will be the person whose image or
images are judged as the best submitted across all the categories;

3.1.3 the winner of Garden Photographer of the Year Portfolio Award 2009 will be the person whose
portfolio is judged as the best portfolio submitted across all the categories.

3.2 Please note that entrants for the Young Garden Photographer of the Year Award 2009 must be under 16 on 31 st January 2009. All Young Garden Photographer of the Year Award 2009 winners will be required to provide proof of age to the Competition organisers. Please ask your parent or guardian for consent before entering.

3.3 There will be one winner and two runners up in each section.


4. CRITERIA FOR ENTRY

4.1 Please follow instructions on the website for naming your files. For more information see Help

4.2 Image files should be uploaded to the Site as jpegs with 800 pixels along the longest length and no bigger than 2mb in size. No responsibility can be taken by the organisers for images that are incorrectly submitted.

4.3 Image files significantly larger than 2mb may be deleted by the system administrator. Normally this will be notified to the photographer but this cannot be guaranteed.

4.4 Digital manipulation by software such as Photoshop is allowed.


5. JUDGING

5.1 A panel of judges, including top garden photographer, Clive Nichols, will assess all images, and a list of finalists will be announced following the closing date of 31st January 2009.


6. SHORTLISTED IMAGES


6.1 After judging, all short-listed entrants will be contacted to verify:

6.1.1 quality of original image file; and

6.1.2 age (if entered into Young Garden Photographer of the Year).

6.2 Short listed entrants that do not meet the criteria set out below will be disqualified:

6.2.1 You should have taken the picture on a camera that will enable good prints to be made from them for the exhibition.This means that you will need to supply high quality jpeg images of around 2 megabytes as an absolute minimum. More advanced users should aim to supply image files in 8bit TIFF format, with a filesize between 20-50 mb – this size would enable us to make larger prints if desired.

6.2.2 Images scanned from transparencies or negatives are also welcome. The high-resolution scan that
will be required for short-listed images should be between 20 and 50mb as an uncompressed tiff file,
although a high-quality jpeg is acceptable. (8 bit, Adobe RGB 1998 colour space).

No responsibility can be taken by the organisers for images that are incorrectly submitted.

6.3 If you have any questions about digital formats, colour spaces and so on, please visit www.gpauk.org, where you will find a set of general digital guidelines that you may find useful.

6.4 All photographers on the shortlist will be contacted by email and will then have around 15 working days to supply a high-resolution file. Failure to produce a high-resolution file of the correct size within the designated time period may eliminate an entrant from the shortlist. However, these rules may be relaxed in certain circumstances - for example, a photograph entered by a child or young person.

6.5 All images not short-listed will be deleted from our server within 48 hours of the announcement of the winners.



7. WINNERS

7.1 Winners will be chosen from among those short-listed entrants who have met the image quality criteria. All winners will be notified by email and the prize presentation ceremony will be held on a date and venue to be announced.

7.2 The decision of the judges is final and no correspondence will be entered into. Should the entries in any category fall below the standard required by the Competition organisers and the judges, then the organisers reserve the right not to award prizes.


8. COPIES

Please ensure that you keep copies of submitted images. The organisers will take all reasonable steps to ensure the safe storage and back up of entries, but cannot be held responsible for exceptional circumstances including Acts of God.


9. PRIZES

9.1 Main Prizes. These prizes were awarded in 2008; 2009 prizes are to be announced.

Best overall Single Image*: £5,000 cash and the title “Garden Photographer of the Year”

Best overall Portfolio: £3,000 cash, £2,000 Calumet Photographic Vouchers, plus more than £1,000 worth of vouchers from Manfrotto, Kata and Visible Dust

Best in Category (eg 'Plant Portraits'): £700 cash, plus more than £700 in Kata, Manfrotto and Visible Dust vouchers

*Best Single Image would also be a Category winner

Runner-up Prizes

Category second place: £250 cash, plus £300 in Kata, Manfrotto and Visible Dust vouchers

Category third place: £250 in Kata, Manfrotto and Visible Dust vouchers

Portfolio second place: £250 cash, plus £600 in Kata, Manfrotto and Visible Dust vouchers

Portfolio third place: £250 in Kata, Manfrotto and Visible Dust vouchers

Special Awards

Young Garden Photographer of the Year: Prizes will be announced shortly

Garden Photographers’ Association Prizes (open to GPA members only):

Best GPA Portfolio: £1,000 cash, plus more than £800 in Kata, Manfrotto and Visible Dust Vouchers

GPA Portfolio second place: £600 in Kata, Manfrotto and Visible Dust vouchers

GPA Portfolio third place: £300 in Kata, Manfrotto and Visible Dust vouchers

The top 100 (approx) winning and finalist images will be shown at a purpose-built outdoor exhibition in Royal Botanic Gardens Kew, London from May to September 2008 to an audience of hundreds of thousands of viewers. They will also be shown on the Garden Photographer of the Year website.

Another 50 (approx) commended images will be shown on the Garden Photographer of the Year website.

9.2 There is no cash alternative and none of the prizes are transferable.


10. COPYRIGHT AND PERMISSIONS

10.1 By submitting images to the Competition, you confirm and warrant that:

10.1.1 you are the sole author of each entry and that it is your original work;

10.1.2 you are the sole owner of the copyright in each image;

10.1.3 you have the permission of those pictured in the image (or, where the image shows any persons
under 18, the consent of their parent/guardian) for the usage rights required by International Garden Photographer of the Year and will indemnify International Garden Photographer of the Year against any claims made by any third parties in respect of such infringement;

10.1.4 you have not licensed or disposed of any rights in the image that would conflict with uses to be
made by International Garden Photographer of the Year;

10.1.5 you have received any necessary permissions from the owner(s) of property included in submitted
images for the usage rights required by International Garden Photographer of the Year;

10.1.6 you will be responsible for any claim by any third party in respect of your entry.

10.1.7 if your photograph was taken in a National Trust property (England, Wales and Northern Ireland) you are aware of the conditions set out below: Paragraph 12.


11. USAGE AND LICENCING OF SHORTLISTED PHOTOGRAPHS

11.1 If your image is NOT shortlisted it will be deleted within 48 hours of the end of the competition.

11.1 If your image is short-listed you will be contacted and invited to grant permission for your image to be used to promote the Competition and exhibition only. For avoidance of doubt, no free usage of any photograph is permitted by International Garden Photographer of the Year, or any of its partners or sponsors outside the scope of the International Garden Photographer of the Year competition and exhibition. There is no plan envisaged by International Garden Photographer of the Year, or any of its partners or sponsors, to create a general commercial archive of photographs entered into this competition.

Failure to agree to this licence will not disqualify any photograph from the competition.

This invitation will state as follows:

11.3.1 You grant International Garden Photographer of the Year and its supporting partners a non- exclusive, irrevocable, royalty free licence to reproduce, enlarge, publish or exhibit, on any media, the photographs for any purpose connected with the Competition. This may include, but is not limited to:
(a) inclusion on the Site and on the websites of sponsors and supporters;
(b) inclusion in associated books;
(c) display at any associated exhibitions;
(d) use in press releases to be distributed to national, regional & specialist press giving information
about or promoting the Competition.

11.3.2 You also agree that the organisers can sub-license images to the media for reproduction in
connection with the Competition and Exhibition only. International Garden Photographer of the Year will make every effort to ensure that name credits are given to any photograph published in any medium.

11.3.3 Images used on any merchandise commissioned by the organisers will be subject to separate
agreements which will be discussed individually with photographers.

12. PHOTOGRAPHY AT NATIONAL TRUST PROPERTIES (ENGLAND, WALES AND NORTHERN IRELAND)

The National Trust is pleased to be able to offer photographers the opportunity to take photographs at its properties for entry into International Garden Photographer of the Year.

As part of that opportunity The National Trust would like to make clear certain conditions that apply. These conditions do not affect the general copyright or licencing conditions of the competition.

12.1 All photography at National Trust properties other than that for private and personal use or for entry into approved competitions is strictly prohibited.

12.2 Photographs taken for private and personal use may not be used in any other context or submitted to any photo libraries or on-line agencies or sold directly to any image buyers. Photographs taken for entry into competitions may not be used in any other context, including submission to any photo libraries or on-line agencies or sold directly to any image buyers, other than those confirmed by the competition organizers.

12.3 Photographers must obtain a National Trust property release form by downloading here. The photographer must print out the property release form which must be signed by appropriate National Trust staff at each of the properties where the photographs are taken.

12.4 Photographing people at National Trust properties must be undertaken with due consideration for their safety and must not interfere with their enjoyment or purpose. An example of a standard model release form is available for download.

12.5 People visiting National Trust properties are on private property and as such have the right to refuse permission to photograph them.

12.6 Every person in a photograph must sign a model release form, or have the form signed on their behalf if they are under 18 years of age, by a parent or legal guardian.

12.7 It is the photographer’s own responsibility to ensure they have explained to subjects the purpose of their photography and to explain how the picture may be used. The National Trust does not accept any responsibility for photography of people undertaken at its properties.

12.8 Terms of entry to every National Trust property should be strictly adhered to by the photographer, paying entry fees or showing an appropriate membership card applies.


13. REFUND POLICY

You have the right to cancel within seven days of uploading your images. If you cancel your upload, your payment will be returned in full and your image deleted.

Please send a refund request to refunds@igpoty.com , using the email address you used to register, providing your full name and quoting the category, image ID number, and image title.
If you have uploaded a portfolio - please also provide the portfolio ID number and portfolio title.


14. PUBLICITY

13.1 Finalists agree to take part in post-Competition publicity.

13.2 Garden Photographer of the Year reserves the right to remove any entries from the Competition that it feels may breach or contravene laws of public decency or may bring the Competition or the Competition’s organisers into disrepute. Such entries will be deemed as void and any fees paid will not be refunded.


15. CHANGES TO THE RULES

We reserve the right to amend the Rules and if we do so, we will publish the amended version on the Site. It is your responsibility to check regularly to make sure you are aware of any updated information. If you do not agree to any changes to these Rules, then your only remedy is to withdraw from the Competition.


16. BREACH OF THE RULES

Any breach of these Rules by you will void your entry. If a breach has occurred, but is discovered after the award of a prize, we may require the return of that prize.


17. GOVERNING LAW

These Rules and the relationship between you and us shall be governed by English law. Any dispute may be decided by the English courts or those of any other part of the United Kingdom.
